ORDER

Challenging the order dated 09.01.2026 passed in Crl.M.P.No.401 of

2026 in Crl.A.No.38 of 2026 on the file of the VI Additional Judge, City Civil Court, Chennai and seeking extension of time of two months to deposit the conditional amount, the petitioner has filed the present petition.

The petitioner/accused was found guilty for the offence under Section 138 of Negotiable Instruments Act in S.T.C.No.114 of 2024 before the XXVI Metropolitan Magistrate Court, Egmore, Chennai, in respect of a cheque amount of Rs.20,00,000/-. By order dated 10.12.2025 made in S.T.C.No.114 of 2024, the petitioner was directed to pay the cheque amount of Rs.20,00,000/- as compensation.

2.1 Aggrieved by the same, the petitioner preferred an appeal in C.A.No.38 of 2026 along with Criminal Miscellaneous Petition before the VI Additional City Civil Court, Chennai, seeking suspension of sentence pending disposal of the appeal. After hearing both parties and on perusal of the records, the said Criminal Miscellaneous Petition was allowed, directing the petitioner to deposit 20% of the cheque amount to the credit of S.T.C.No.114 of 2024 before the trial Court, within a period of 60 days from the date of the order.

The grievance of the petitioner is that the time for depositing 20% of the cheque amount expired on 09.03.2026. Since the petitioner had undergone medical treatment, he was unable to mobilise the amount within the stipulated

time. Hence, the petitioner filed a petition, seeking extension of time to comply with the order dated 09.01.2026 and the same was not entertained.

The learned counsel for the petitioner submitted that the petitioner is now ready and willing to deposit a sum of Rs.4,00,000/- (Rupees Four Lakhs only) to the credit of S.T.C.No.114 of 2024 before the trial Court and seeks further time to comply with the order dated 09.01.2026 made in Crl.M.P.No.401 of 2026.

Considering the above submission and recording the undertaking made by the learned counsel for the petitioner, this Court is inclined to dispose of the Criminal Original Petition on the following directions:

(i)The petitioner shall deposit a sum of Rs. 4,00,000/- (Rupees Four Lakhs only), to the credit of S.T.C.No.114 of 2024 before the trial Court, within a period of two weeks from today.

(ii) It is made clear that no further extension will be granted.

(iii) In case, the petitioner fails to comply with the condition

stated supra, the order dated 09.01.2026 in Crl.M.P.No.401 of
