COMMON ORDER

The petitioners in Crl.O.P.Nos.6625 and 6627 of 2026, who were arrested

and remanded to judicial custody on 05.12.2025 and 10.12.2025 respectively for

the alleged offence under Section 103 of BNS subsequently altered to Sections

¶21

103, 191(2), 191(3), 61(2), 126(2), 3(5), 190, 49 and 238 of BNS in PRC No.5

of 2026 and the petitioner in Crl.O.P.No.6775 of 2026, was arrested and

remanded to judicial custody on 06.12.2025 for the offence under Sections 103, 191(2), 191(3) and 61(2) of BNS Act in Cr.No.388 of 2025 on the file of the respondent police, seek bail.

It is the case of the prosecution that due to previous enmity, the

petitioners along with other accused conspired together and murdered the deceased with deadly weapons, due to which the deceased was succumbed to death. Hence, the complaint.

The learned counsels appearing for the petitioners submit that the petitioners were arrested and remanded to judicial custody since 05.12.2025, 10,12,2025 and 06.12.2025 respectively. They further submit that the petitioners have no previous cases pending against them and that the investigation has already been concluded. Hence, they seek to grant bail to the petitioners. They further submit that A2 and A6 were already granted bail vide orders dated 07.02.2026 and 09.02.2026 respectively by the learned Principal Sessions Judge, Krishnagiri in Crl.M.P.Nos.465 and 389 of 2026 respectively.

The learned Government Advocate (Crl.Side) submits that these petitioners are under incarceration since 05.12.2025, 10,12,2025 and 06.12.2025 respectively. Though the learned Government Advocate (Crl.Side) opposed to grant bail to the petitioners on the ground that A1 has got two

previous cases, he fairly submits that the investigation has been completed and the charge sheet has also been taken on file in P.R.C.No.5 of 2026.

I have given my anxious consideration to the submissions made by the learned counsel on either side and also perused the records available.

In view of the above submissions made by the learned counsel on either side and taking into consideration the fact that there are no previous cases against the petitioners except A1 who is having two previous cases which is in respect of Immoral Traffic (Prevention) Act, 1956 and also considering the period of incarceration undergone by the petitioners, this Court is inclined to grant bail to the petitioners, subject to certain conditions.

Accordingly, the petitioners are ordered to be released on bail on his executing a bond for a sum of Rs.25,000/- each (Rupees Twenty Five Thousand only) , with two sureties each for a like sum to the satisfaction of the Judicial Magistrate No.II, Hosur, and subject to the following conditions:

(a) The sureties shall affix their photographs and left thumb impression in the application for surety ship (Judicial Form No.46 annexed to 'The Criminal Rules of Practice, 2019]'. The learned Magistrate shall obtain a copy of any one of identify proofs to ensure their identity;

(b) The petitioners shall make themselves available for

interrogation as and when required by the investigation officer;

(c) The petitioners shall appear and sign before the respondent Police, daily at 09.00 a.m. until further orders. The condition which is being imposed to be complied without any deviation. No further application will be entertained for a period of 30 days;

(d) The petitioner shall not abscond either during investigation or trial;

¶46

(e) The petitioner shall not tamper the evidence or witness either during investigation or trial;

¶47

(f) On breach of any of the aforesaid conditions, the learned Magistrate/Trial Court is entitled to take appropriate actions against the petitioner in accordance with law as if the conditions have been imposed and the petitioner released on anticipatory bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji v. State of Kerala [(2005) AIR SCW 5560];

(g) If the petitioner thereafter absconds, a fresh FIR can be registered under Section 269 of BNS Act.
