ORDER

The petitioner, who was arrested and remanded to judicial custody on 02.02.2026 for the alleged offences under Sections 69 and 79 of BNS Act, 2023, in Crime No.10 of 2026 on the file of the respondent police, seeks bail.

2.The allegation against the petitioner is that he developed intimacy with

the victim, aged about 21 years, under the pretext of marrying her, and had a physical relationship with her, which resulted in pregnancy. Subsequently, the petitioner refused to marry her. However, the victim has not lodged any complaint against the petitioner. It is further stated that she delivered a baby and thereafter suffered severe bleeding, which necessitated her admission to the hospital. At that time, she disclosed the pregnancy and delivery of the child, following which the police intervened, rescued the child, and handed over the

baby to the mother. Hence, the case has been registered and the petitioner has been arrested.

3.The learned counsel for the petitioner submitted that a compromise has been entered into between the parties for the welfare of the child. He further submitted that the petitioner has been in incarceration from 02.02.2026 and he is ready to co-operate with the trial process. Hence, he prayed to grant bail to the petitioner.

The learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and, upon instructions, submitted that the statement of the victim girl has been recorded under Section 183 of BNSS. It revealed that the petitioner is the person who had a physical relationship with her, and that she subsequently delivered the child. Hence, he opposed to grant bail to the petitioner.

5.Considering the nature of the allegations and other circumstances of the

case and also taking into account the period of incarceration, this Court is inclined to grant bail to the petitioner, subject to certain conditions.

Accordingly, the petitioner is ordered to be released on bail on executing a bond for a sum of Rs.20,000/- (Rupees Twenty Thousand Only) with two sureties, for a like sum to the satisfaction of the learned Judicial

Magistrate Court No-I, Ponneri, and on further conditions that:

[a] the sureties shall affix their photographs and Left Thumb

Impression in the Application for Surety ship [Judicial Form No.46 annexed to 'The Criminal Rules of Practice, 2019']. The learned Magistrate shall obtain a copy of any one of the identity proofs to ensure their identity;

¶32

[b] the petitioner shall report before the respondent police everyday at 10:30 a.m., for a period of three weeks and thereafter as and when required for interrogation;

[c] On breach of any of the aforementioned conditions, the learned Magistrate/Trial Court is entitled to pass appropriate orders against the petitioner in accordance with law as if the aforementioned conditions have been imposed and the petitioner released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [ (2005)13 SCC 283 ];

[d] If the accused thereafter absconds, a fresh FIR can be registered under Section 269 of B.N.S.
