The criminal original petition is filed to quash the FIR in crime No.141 of 2026 on the file of the first respondent.

2.Upon considering the FIR, it can be seen that there is dispute between adjacent land owner, on account of which, it is alleged that the accused had attack the de facto complainant with hands and legs and the case is registered for the offences under Sections 296(b), 115(2) of BNS and Section 4 of Tamil Nadu Prohibition of Harassment of Women Act.

3.The learned counsel for the petitioner would submit that there is also

counter case that is registered at the behest of the petitioner’s herein.

4.Considering the said submission, it can be seen that separate occurrences are alleged. Therefore, let both the cases be investigated dispassionately by the investigating officer. Since the submissions made that the case is false case is factual in nature, keeping open the liberty of the petitioner to raise the same at the appropriate stage, the prayer to quash the FIR itself cannot be entertained. Accordingly, this criminal original petition is disposed of. Consequently, connected miscellaneous petition is closed.
