The petitioner, who was arrested and remanded to judicial custody on 25.03.2026 for the alleged offences under Sections 406 and 420 of the I.P.C., in

Crime No.16 of 2026 on the file of the respondent police, seeks bail.

The case of the prosecution is that the petitioner, along with the other

accused advised the defacto-complainant to invest in Infinite Fincorp, by promising 5 % monthly return. Consequently. the defacto-complainant, his

family relatives and his friends invested a total Rs.35,00,000/-. It is alleged that the petitioner paid the returns until January 2024, he subsequently failed to make further payments or return the principal investment. Hence the case.

3.The learned counsel for the petitioner submitted that the petitioner is innocent and has been in custody since 25.03.2026. He further submitted that there are two cases of a similar nature pending against the petitioner and in one such case, this Court granted bail on 27.04.2026 in Crl.O.P.No.10505 of 2026. Hence, he prays to grant bail to the petitioner in the present case as well.

4 .The learned Government Advocate (Criminal Side) appearing for the respondent police submitted that the petitioner cheated the victims of a sum of Rs.35,00,000/- through online fraud. He further submitted there are approximately five victims, and all of whom are the petitioner’s relatives. Hence, he opposed for grant of bail to the petitioner.

5.Though there are allegations of fraud against the petitioner, considering his incarceration since 25.03.2026, this court is of the firm view that his further custody is not necessary. Consequently, this Court is inclined to grant bail to the petitioner with certain conditions.

Accordingly, the petitioner is ordered to be released on bail on his executing a bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only), with two sureties each for a like sum to the satisfaction of the learned

Judicial Magistrate, Poonamallee, and subject to the following conditions:

[a] the sureties shall affix their photographs and Left Thumb Impression in the Application for Surety ship [Judicial Form No.46 annexed to 'The Criminal Rules of Practice, 2019']. The learned Magistrate shall obtain a copy of any one of the identity proofs to ensure their identity;

¶29

[b] the petitioner shall report before the respondent police daily evening at 05.30 PM for a period of three weeks; thereafter as and when required for interrogation;

¶30

[c] the petitioner shall not abscond either during investigation or trial;

¶31

[d] the petitioner shall not tamper with the evidence or witness either during investigation or trial;

¶32

[e] on breach of any of the aforementioned conditions, the learned Magistrate/Trial Court is entitled to take appropriate action against the petitioner in accordance with law as if the conditions had been imposed and the petitioner released on bail by the learned Magistrate/Trial Court itself, as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)13 SCC 283];
