The petitioners/ accused who apprehend arrest at the hands of the respondent/police for the offences under Sections 296(b), 115(2), 351(3) of BNS R/W sec. 4 of TNPWH Act, 1998, in Crime No.79 of 2026, seek anticipatory bail.

The case of the prosecution is that on 24.04.2026, there was a wordy quarrel between the petitioners and the de facto complainant. Hence, the complaint.

The learned counsel for the petitioners would submit that the petitioners are innocent persons and they have not committed any offence as alleged by the prosecution. Due to political posting disputes between the petitioner and the de facto complainant , the de-facto complainant has lodged a false complaint. Therefore, he prays to grant anticipatory bail to the petitioners.

The learned Government Advocate (Criminal side) would submit that the petitioners have abused, attacked and threatened the de facto complainant. Therefore, he opposed for the grant of anticipatory bail to the petitioners.

Considering the facts and circumstances of the case, and there is no previous case is reported as against the petitioner, also the fact that the petitioners have come forward to deposit an amount of Rs.10,000/- to the credit of "Tamil Nadu Advocate Clerk Association, Chennai”, this Court is inclined to grant anticipatory bail to the petitioners on certain conditions.

Accordingly, the petitioners shall pay a sum of Rs. 10,000/- (Rupees Ten thousand only) as cost to the Tamil Nadu Advocate Clerk Association, Chennai and on such payment, the petitioners are ordered to be released on bail in the event of arrest or on their appearance, within a period of fifteen days from the date on which the order copy made ready, before the learned Judicial Magistrate, Tittakudi combined Court, on condition that the petitioners shall execute a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only), each with two sureties, for a like sum to the satisfaction of the learned Magistrate concerned, and on further conditions:

a)the sureties shall affix their photographs and left thumb impression in the surety bond and the Magistrate/concerned court may obtain a copy of their Aadhar card or Bank Pass Book to ensure their identity;

b)the petitioners shall report before the respondent police daily at 10.30 a.m., for two weeks and thereafter, as and when required for interrogation, until further orders;

¶33

c)the petitioners shall not tamper with evidence or witness;

d)the petitioners shall not abscond during trial;

e)On breach of any of the aforesaid conditions, the learned

¶39

Magistrate/Trial Court is entitled to take appropriate action against the petitioners in accordance with law as if the conditions have been imposed and the petitioners released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)AIR SCW 5560].

f) If the accused thereafter abscond, a fresh FIR can be registered under Section 269 of BNS.
