PRAYER: The criminal original petition filed under Section 528 of BNSS to direct the Learned XV Additional Sessions Judge, City Civil Court, Chennai to receive the petition for extension of time granted in the order dated 13-2-2026 in MP 1 of 2026 in Crl A. 196 of 2026 passed by the Learned XV Additional Session Judge, City Civil Court, Chennai and consequently extend the time limit for making the deposit of compensation on its own merits and pass such other orders as it may deem fit and proper in the interest of justice.

This criminal original petition has been filed to direct the Learned XV Additional Sessions Judge, City Civil Court, Chennai to receive the petition for extension of time and consequently extend the time limit for making the deposit of compensation.

2.It is seen that the petitioners are accused under Section 138 of the Negotiable Instruments Act and were convicted by the trial Court in STC.No.9688/2023. Against the conviction, appeal in Crl.A No.196 of 2026 preferred before the XV Additional Sessions Judge, Chennai. Pending the appeal, the petitioners filed a petition in M.P.No.1 of 2026 seeking suspension of sentence. The Sessions Judge, by order dated 13.02.2026 suspended the sentence in respect of the 2^nd petitioner alone on the condition that the 2^nd petitioner is to deposit 20% of the cheque amount of Rs.31,08,200/- within a period of 30 days.

3.The learned counsel for the petitioners submitted that the 2^nd petitioner was unable to mobilise the fund immediately within the time granted by the trial Court. After a delay of 19 days, the 2^nd petitioner mobilised the amount and produced the Demand Draft for a sum of Rs.6,21,640/- drawn on State Bank of India, Egmore branch, which was not accepted by the trial Court.
