This criminal miscellaneous petition has been filed to cancel the

anticipatory bail granted to the respondents 2 and 3 / accused in Crl.O.P.No.22162 of 2024 dated 12.09.2024 as the respondents 2 and 3 have violated the conditions stipulated by this Court in the said order.

The learned counsel for the petitioner submits that the respondents 2 and 3 have not complied with the conditions imposed by this Court by order dated 12.09.2024. According to the petitioner, this Court had directed the respondents 2 and 3 to pay a sum of Rs.20,00,000/- within a period of three weeks from the date of the said order. Since the respondents 2 and 3 have failed to pay the said amount within the stipulated time, the learned counsel prayed that this Court may cancel the anticipatory bail granted to them.

I have given my anxious consideration to the submissions made by the learned counsel for the petitioner and the learned Government Advocate (Crl.Side) appearing for the first respondent and perused the materials available on record.

Upon perusing the order passed by this Court, it is seen that the respondents 2 and 3 were granted anticipatory bail subject to the condition that they shall pay a sum of Rs.20,00,000/- within a period of three weeks from 12.09.2024. The question of cancellation of bail would arise only after the respondents 2 and 3 are enlarged on anticipatory bail. In the present case, though such an order has been passed, the respondents 2 and 3 have not complied with the said condition and have not availed the benefit of anticipatory bail so as to warrant cancellation of the same.
