This petition has been filed to restore the Criminal Original Petition in Crl.O.P.No.23674 of 2025 which was dismissed for non-prosecution on 05.02.2026.

2.The reason given by the learned counsel for the petitioner for not appearing on 05.02.2026 is that, when he was present in Court, he suddenly suffered from Chicken Pox and he left the Court premises. Hence, he was unable to be present when the matter was called.

3.The learned Additional Public Prosecutor appearing for the 1^st respondent raised strong objections to allow this petition.

¶44

4.However, satisfied with the averments assigned in the affidavit filed in support of this petition, this Court is inclined to allow this petition.

¶45

5.Accordingly, this petition is allowed and the Criminal Original Petition is restored to file.
