The petitioner has preferred the above revision challenging the judgment dated 07.11.2025 passed in Crl.A.No.221 of 2024 by the learned III Additional District and Sessions Judge, Coimbatore modifying the judgment dated 18.06.2024 passed in C.C.No.375 of 2015 by the Judicial Magistrate Court No.V, Coimbatore. The Trial Court had convicted the petitioner for the offences under Sections 457 and 380 IPC and sentenced him to undergo simple imprisonment for a period of three years together with a fine of Rs.1000/- carrying a default sentence of simple imprisonment for three months in respect of each of the aforesaid offences. The Sessions Court, while confirming the conviction, had reduced the sentence to six months simple imprisonment in respect of each of the aforesaid offences.

2.The instant criminal miscellaneous petition has been filed seeking suspension of sentence imposed on the petitioner.

3. The case of the prosecution is that the petitioner, who is A1 along with A2 had committed theft of Lenovo Laptop, Hard Disk and a letter containing the SBI ATM card PIN number from the office of the de facto complainant and had also withdrawn a sum of Rs.10,500/- and thus committed the aforesaid offences.

Learned counsel for the petitioner would submit that the petitioner has raised substantial grounds in the revision; that there are several inconsistencies in the evidence adduced on the side of the prosecution; that pursuant to the impugned order, the petitioner had surrendered before Judicial Magistrate Court No.V, Coimbatore on 09.02.2026 and hence, prayed for suspension of sentence.

5 . Learned Government Advocate (Crl.Side) confirms that the petitioner had surrendered and is now in judicial custody.

6 . Considering the fact that the petitioner has raised substantial grounds in the revision, which require consideration; that the revision is not

in Crl.R.C. No. 36 of 2026 likely to be taken up in the near future and the fact that the petitioner had surrendered and is in custody, this Court is inclined to grant the relief of suspension of sentence to the petitioner.

7 . Accordingly, this criminal miscellaneous petition stands

allowed and the sentence imposed on the petitioner is suspended till the disposal of the above criminal revision and the petitioner is ordered to be released on bail on the following conditions:

(i)The petitioner shall execute a bond for a sum of Rs.10,000/-, (Rupees Ten Thousand only) with two sureties, each for a like sum to the satisfaction of the Judicial Magistrate Court No.V, Coimbatore;

(ii)The petitioner and the sureties shall affix their photographs and Left Thumb Impression in the surety bond and the Trial Court may obtain a copy of their Aadhar card or Bank pass Book and mobile numbers to ensure their identity; and

¶39

(iii)The petitioner shall appear before the Trial Court on the first working day of every month at 10.30 a.m. until the disposal of the revision and if he is not able to appear before the Trial Court on any day, he shall make arrangements to file an application under Section 317 Cr.P.C. and shall appear before

the Trial Court on any other day in lieu of the date of his absence, as directed by the Trial Court.
