This criminal miscellaneous petition has been filed to grant for a period of seven months time to file the final report as per the direction given by this Court in its order dated 04.08.2025 made in Crl.MP.No.14804 of 2025 in Crl.OP.No.16036 of 2024.

2.When the matter was taken up for hearing, the learned Govt. Advocate (Crl.Side) seeks further period of seven months time to complete the investigation. In this regard, the Additional Superintendent of Police, Vigilance and Anti-Corruption, Namakkal, filed an affidavit, wherein paragraphs 9 & 10, stating the following reasons for extension of time in completing the investigation, which are extracted hereunder:

“9.It is further submitted that in this case, so far 131 documents were collected out of 968, and the balance of 837 documents are to be collected. Similarly, 43 witnesses were examined out of 214, and the remaining 171 witnesses are to be examined. Furthermore, it is alleged invariably in all the allegations that the offences were purportedly committed with the active aid of the officials of Vennandur Union. The allegations were made nearly a decade ago. There are difficulties in securing the documents from the competent

authorities. However, the available documents are under scrutiny to ascertain the involvement of the officials from Vennandur Union.

10.It is further submitted that if additional public servants are found to be involved in the commission of the offences with the active aid of Panchayat Officials, the competent authorities have to be addressed seeking prior approval under Section 17-A of the Prevention of Corruption of Act, 1988 as amended in 2018 as all the alleged offences are relatable to recommendation made and decision taken by the officials in the course of discharging their official functions. The investigation can be pursued against them only after obtaining prior approval from the competent authorities. After receiving the prior approvals and completing the investigation, prosecution sanctions have to be obtained from the competent authorities. This entire process cannot be finalized and a final report cannot be filed before 04.12.2025 in accordance with the directives of this Hon’ble Court.”

3.Considering the nature of investigation, this Court grants six months

time to complete the investigation. Accordingly, the criminal miscellaneous petition is ordered granting 6 more months to complete the investigation.
