PRAYER: Criminal Miscellaneous Petition filed under Section 528 of BNSS, 2023, praying to grant further period of six months time to complete the investigation and file the final report as per the direction given by this Court in its order dated 07.07.2025 made in Crl.M.P.No.13112 of 2025 in Crl.O.P.No.6247 of 2025.

The respondent herein filed a quash petition before this Court in Crl.O.P.No.6247 of 2025 and this Court, by order dated 05.03.2025 disposed

of the petition on the undertaking given by the learned Government Advocate that petition for further investigation filed and further investigation is under process and the same would be completed within a period of two months. Thereafter, due to other intervening circumstances, further delay has caused. Hence, filed the above petition.

passed by this Court on 05.03.2025, further investigation could not be completed within the stipulated period. Hence, filed Crl.M.P.No.13112 of 2025 and this Court, by order dated 07.07.2025 granted four months time. Thereafter too, the investigation could not be completed as expected. In the meanwhile, the first accused/Sundarrajan filed a quash petition before this Court in Crl.O.P.No.26502 of 2022, in which, the learned Government Advocate submitted that first accused appears to be a whistle blower and if the investigation confirms the same, he would be transposed as witness. Recording the same, the petition was disposed of on 16.11.2022.

3.The learned Government Advocate further submitted that the second accused in this cases filed a discharge petition, which is pending before the trial Court and the case is posted on 27.03.2026. From the discharge petition filed, it is seen that there are some more documents to be collected, in the meanwhile, departmental action initiated on the petition of A1/Sundarrajan and the files are now pending in the departmental proceedings. Hence, filed the above petition.

4.The learned counsel for respondent/Mathivanan/A3 submitted that

prosecution seems to be taking its own time to save the persons involved in this case and not conducting proper investigation and only adopting all dilatory tactics.

5.The learned counsel for A1/Sundarrajan submitted that A1 was exonerated in the departmental proceedings and to his information there is no departmental proceedings pending. It is now projected that files were kept with the department, which is not true. The petitioner, investigating agency already had access of all the files and it is only a dilatory tactics adopted to ensure that the case further delayed and has a natural death. He further submitted that in this case the grounds raised by the investigating agency is that files are with the department but at the same time, makes a submission that the discharge petition of A2 is pending before the trial Court. The discharge petition of A2 has nothing to do with the further investigation. Further investigation has to be completed without further delay.

CRL MP No. 21509 of 2025 in CRL OP NO. 6247 OF 2025 6.Considering the submissions made and on perusal of the material, it is seen that the investigation requires some more time to collect the documents. In view of the above, further period of four months is granted to complete the investigation and no further extension of time would be granted.

7.Accordingly, the Criminal Miscellaneous Petition is ordered.
