This Criminal Miscellaneous Petition has been filed seeking relaxation of

the condition imposed in paragraph 4(c) of the order dated 24.11.2025 passed in Crl.M.P. No.22116 of 2025 in Crl.R.C. No.2493 of 2025 which is extracted

hereunder:

“(c) The petitioner shall appear before the Trial Court on every Tuesday at 10.30 a.m., until the disposal of the Criminal Appeal and if he is not able to appear before the trial court on any day, he shall make arrangements to file an application under Section 355 of BNSS, 2023, and shall appear before the trial Court on any other day in lieu of the date of his absence, as directed by the trial Court.”

2.The learned counsel for the petitioner submitted that the petitioner has been regularly complying with the condition of appearing before the Trial Court every Tuesday at 10.30 a.m. It is further submitted that the petitioner is employed as a driver of a water tanker lorry and his weekly appearance before the Trial Court causes loss of one day's wages and hardship to his livelihood. The petitioner has expressed his willingness to continue appearing before the Trial Court as directed by this Court, if the condition is suitably modified.

3.Considering the submissions made and the fact that the petitioner has

been complying with the earlier condition without any violation, this Court is inclined to relax the condition imposed in paragraph 4(c) of the order dated 24.11.2025.

4.Accordingly, only the condition contained in paragraph 4(c) of the order dated 24.11.2025 is modified as follows:

¶28

“ The petitioner shall appear before the Trial Court on the first working day of every English calendar month at 10.30 a.m. until the disposal of the Criminal Revision Case or until further orders. If the petitioner is unable to appear on any such day for valid reasons, he shall file an appropriate application before the Trial Court and appear on such other date as may be directed by the Trial Court. ”

All the other conditions imposed in the order dated 24.11.2025 in Crl.M.P. No.22116 of 2025 in Crl.R.C. No.2493 of 2025 shall remain unaltered.

5.Accordingly, this Criminal Miscellaneous Petition is ordered .
