judgment, dated 26.11.2025, made in A.S.(MD)No.142 of 2018.

3.In the above first appeal, this Court, after hearing both sides, remitted the matter back to the trial Court and had directed that the trial Court shall examine the evidence already on record, considering the written arguments already submitted, hear the arguments and then pronounce judgment answering all issues framed. However, in the course of the judgement, it had also been observed that the petitioners/defendants in the suit had not tendered any evidence. They had, however, filed a written statement. Hence, the petitioners seek clarification whether the petitioners are permitted to tender evidence.

3.After hearing both sides, it is clarified that both the plaintiffs in the suit and the defendants in the suit are permitted to tender additional evidence, however, we would fix a time limit for the said process to be completed and we would direct that the tendering of evidence by the plaintiffs and by the defendants and the pronoucement of judgment in the suit should be completed on or before 30.11.2026. It is clarified that if

the plaintiffs are tendering evidence, only those additional witnesses could be cross examined by the defendants and PW-1 and PW-2 cannot
