C.M.P(MD)No.1005 of 2025 in W.A(MD) SR No.5614 of 2025, which was dismissed for default on 07.03.2025.

2.The condition to pay a sum of Rs.500/- to the High Court Legal Services Committee attached to this Bench to condone the delay of 149 days in preferring an appeal has not been paid by the appellant within the time prescribed. Therefore, the application was authomatically dismissed as per the order passed by this Court in CMP(MD) No.1005 of 2025 dated 07.03.2025. To restore the said application, the present petition in CMP(MD) No.607 of 2026 is filed.

3.We find that even in the application for restoration, there was a delay of 162 days, which was condoned by this Court vide order dated 08.01.2026 in CMP(MD No.19608 of 2025. Taking into consideration the repeated default in not pursuing the application in time, we are of the view that a cost of Rs.5000/- to be imposed as condition to allow the restoration application. Accordingly, this Civil Miscellaneous Petition stands allowed on payment of cost of Rs.5,000/(Rupess Five Thousand only) to the High Court Legal Services Committee attached to this Bench on or before 06.02.2026. In the event of any failure, no
