The delay of 143 days in preferring the Second Appeal is sought to be

condoned.

2. I have heard the learned Counsel for the petitioner and the contesting first respondent. The Government is a formal respondent [third respondent].

3. Independently, going through the averments set out in the affidavit filed in support of this application, I am satisfied that the delay has been reasonably explained by the petitioner in the affidavit filed in support of the condone delay application. However, at the same time, the prejudice caused to the contesting first respondent has to be necessarily compensated.

4. Accordingly, this Civil Miscellaneous Petition is allowed on payment of Rs.2,000/- to the learned Counsel for the first respondent within a period of one [1] week.
