PRAYER – This Civil Miscellaneous Petition is filed under Section 5 of Limitation Act, to condone the delay of 13 days in filing the Appeal Suit to set aside the judgment and decree dated 16.09.2025 made in O.S.No.111 of 2015 passed by the V Additional Principal Judge, Family Court, Chennai pending disposal of this Appeal Suit.

The petition has been filed seeking to condone the delay of 13 days in

filing the Appeal Suit against the judgment and decree dated 16.09.2025 made in O.S.No.111 of 2015 on the file of the V Additional Principal Judge, Family Court at Chennai. .The 1^st , 2^nd and 3^rd defendants in the said suit are the appellants herein. The suit had been decreed in favour of the respondents.

2.It had been stated in the application that the delay is neither wilful nor

wanton. Notice had been directed to the respondents and counsel had also entered appearance on behalf of the 1^st respondent, who was the plaintiff in the suit.

3.Taking into consideration the fact that the Appellate Court has a duty to
