This Petition has been filed to condone the delay of 429 days in filing the Second Appeal as against he judgment and decree in A.S.No.72 of 2023 dated 16.02.2024 on the file of the III Additional District and Sessions Court, Virudhachalam, in confirming the Judgement and decree in O.S.No.74 of 2019, dated 29.07.2022 on the file of the Subordinate Judge, Neyveli.

appearing for the respondent and perused the material available in the record.

On being satisfied with the averments stated in the affidavit filed in

support of the petition and the submissions made by the learned counsel on both sides, this Court is inclined to condone the delay, subject to costs.

The petitioner / appellant is directed to pay a sum of Rs.2,000/(Rupees two thousand only) to the learned counsel for the respondent on or before 25.02.2026. On such payment, the delay of 429 days in filing the above SA.SR.No.185259 of 2025, stands condoned.
