The learned counsel for the respondent contended that the appeal had been filed against a money decree granted on the basis of the goods sold and delivered and amount not paid. It is stated that to set aside an ex-parte decree, an application had been filed and a sum of Rs.15,00,000/- had been directed to be deposited. That amount had accrued interest. The respondents are permitted to take steps to withdraw the sum of Rs.15,00,000/- together with accrued interest and also the costs component.

2.It is also stated by the learned counsel for the appellants that properties are under attachment and that the value of the properties far exceeds the decree amount.

3.The petition for stay stands closed by making the stay absolute till the disposal of the appeal, however, granting permission to the respondent as aforestated to withdraw the amount mentioned therein.
