This case came up for settlement before the Lok Adalat. Both the parties present. The counsel for the appellant/s Mr.T.Sivakumar and the counsel for the second respondent/s Mr.G.Prabhu Rajadurai, are present. After mutual discussion, negotiation, mediation and conciliation between both parties and with the assistance of the Bench, both sides consented for settlement.

AWARD

The appeal is at the instance of the claimants, who are children of the deceased Mariammal, grand-children through pre-deceased daughter Uma Rani and the husband of the deceased. The Tribunal has awarded a sum of Rs.5,84,800/-, entitling only the husband to the entire compensation amount. The present appeal has been filed by the children, pre-deceased daughter's children as well as husband seeking enhancement.

2.Today, all the parties are present. After negotiation with the Insurance Company, the parties have agreed to the following settlement:

“(i) The award amount has been enhanced to Rs.8,09,800/- [Rupees Eight Lakhs Nine Thousand and Eight Hundred] together with proportionate interest and cost.

(ii) The apportionment shall be in five equal shares. One share is to the appellants 1 to 3 [each], another one share to the appellant 4 to 7 jointly and one share to the 8^th appellant.”

3.It is brought to our notice that the respondent / Insurance company has already deposited

the entire award amount together with proportionate future interest. Hence, the balance amount payable by the Insurance Company shall be paid within a period of four [4] weeks from the date of receipt of a copy of this order. The appellant / claimants are permitted to withdraw their respective shares of the award amount without filing any formal petition.

4.This Civil Miscellaneous Petition is disposed of on the above terms. No costs. Connected miscellaneous petition is closed.

The full Court fee paid shall be refunded to the appellant in the manner provided under Section 69-A of the Tamilnadu Court Fees and Suits Valuation Act, 1955 and the Court Fees Act, 1870 as provided for under sub Sec.1 of Section 21 r/w 25 of LSA Act 1987 as amended in 1994.

The Original of the award shall be place in the court record and copy of the award, kept with High Court Legal Services Committee and one copy each is furnished to both parties free of cost.

In agreement of the above, both parties and their counsel have affixed their signatures/ thumb impressions in presence of the Lok Adalat Bench admitting the terms and today conditions and accordingly, the award is passed.
