Insurer's appeal under Section 173, Motor Vehicles Act 1988 against the Tribunal's award of Rs.40,00,000/- dated 12.02.2020 in a fatal motor accident case (deceased Karthik, 24, a painter; accident 18.02.2014 with Tipper Lorry AP 31 TA 1567 whose owner, the fifth respondent, remained ex parte). Liability: premium cheque dishonoured on 06.01.2014; policy cancelled and intimation sent by registered post, but acknowledgement cards/proof of delivery to the insured and the Road Transport Office, Nellore were not produced. Held, following the Larger Bench decision in Oriental Insurance Co. Ltd. v. Inderjit Kaur ((1998) 1 SCC 371) that honouring third-party risks — the public interest served by an insurance policy — prevails over the insurer's interest: the insurer must pay the compensation and recover it from the insured/owner (pay and recover). Observes (obiter) that Section 64VB, Insurance Act (no risk without premium received in advance) prevails over the IRDAI (Manner of Receipt of Premium) Regulations, 2002 'void ab initio' provision. Quantum (per corrected paras 38-40): future prospects fixed at 40% and notional income reduced to Rs.13,000/- p.m. per Pranay Sethi (2017 (2) TNMAC 601); three dependents including the father, ¼ share (Rs.4,550/-) deducted; net monthly income Rs.13,650/-, annual Rs.1,63,800/-; multiplier 18 per Sarla Verma ((2009) 6 SCC 121); loss of dependency Rs.29,48,400/-; loss of consortium Rs.1,60,000/- (Rs.40,000 x 4), funeral expenses Rs.15,000/-, loss of estate Rs.15,000/-; loss of love and affection removed as included in loss of consortium per Satinder Kaur (MANU/SC/0500/2020 : (2021) 11 SCC 780). Total compensation reduced to Rs.31,38,400/- (from Rs.40,00,000/-), to be deposited with interest at 7.5% p.a. from the date of petition within six weeks and recovered from the insured; minor's share in a nationalised bank till majority, mother permitted quarterly withdrawal of accrued interest for the minor's welfare; appeal partly allowed; no costs; connected miscellaneous petition closed.
