When the matter taken up for hearing the learned counsel for the claimant

submits that on 18.06.2019 they were not been heard but the appeals were

closed as if matter was settled but as on date the claimant have not received any

compensation. Besides, they contested the dismissal order passed by the

tribunal against six claims enhanced and one claim dismissed.

The learned counsel for the respondent submits that according to his

instruction the claimants/appellants have received amount through execution proceedings. By way of reply, the learned counsel for the appellants submit that it is batch of cases in some of the cases injured persons were received compensation through execution proceedings but not the present claimants/appellants, thus there was mistaken representation.

On perusal of records, it reveal that on the date of disposal of the said

appeals there was no representation on the side of the claimants/appellants and

¶114

the cases also not settled in Lok Adalat. In order to avoid multiplicity of proceedings and in the interest of justice, this Court is inclined to recall the

judgement dated 18.06.2019. Post the matter on 17.10.2025.
