Today, the matter is listed under the caption 'For Being Spoken to'

The present application has been filed seeking the appointment of a sole arbitrator to adjudicate upon the differences and disputes arising out of the arbitration agreement between the parties.

The learned counsel appearing for the respondent indicated that a panel

of arbitrators should be appointed to resolve the dispute, and suggested that a retired judge be nominated on their behalf.

Further, it is noted that the value of the claim alleged to be made before the arbitrator is Rs. 5 Crores. In that regard, when the matter was listed under the caption 'For Being Spoken to' to ascertain the views of the learned counsel regarding the appointment of arbitrators, the learned counsel on either side suggested the following names for appointment as arbitrators:

The petitioner nominates Mr. V. Raghavachari, Senior

Advocate, High Court of Madras, as its arbitrator.

From the list submitted in the memo filed, the respondent nominates Mr. D. Saravanan, Advocate, as its arbitrator.

In view of the above, this Court appoints Mr.Justice P.Kalaiyarasan, retired Judge of this Court, residing at Plot No. 64, 3^rd Cross Street, C.B.I. Colony, Kandanchavadi, Chennai – 600 096 (Apollo Hospital Back side) [Mob.Nos.99424 21667, 044-79682493] as preceding Arbitrator.
