This application is filed to grant leave to the applicant / plaintiff to

sue the respondents / defendants 1, 3, 5, 6, 7, 8, 9, 10, 13 and 15.

According to the applicant, he is the plaintiff in the main suit and

filed the suit for declaration of title of the property. The suit properties are situated within the jurisdiction of this Court and the defendants 1, 3, 5, 6,

7, 8, 9, 10, 13 and 15 are residing outside the jurisdiction of this Court.

A No. 521 of 2026 Therefore, a substantial part of the cause of action has arisen within the

jurisdiction of this Court and the suit can be instituted before this Court.

This Court heard petitioner side and perused the records.

¶53

Considering the nature of suit, that the suit properties are situated

¶54

within the jurisdiction of this Court and the defendants 1, 3, 5, 6, 7, 8, 9, 10, 13 and 15 are residing outside the jurisdiction of this Court, substantial part of cause of action arose within the jurisdiction of this Court and also taking note of the facts and circumstances of the case, this court is inclined to allow this petition and therefore, leave is granted as prayed for.
