The petitioner apprehends arrest for the alleged offences under Sections 275 and 123 of BNS 2023 and Sections 6(b) and 24(1) of the Cigarettes and

Other Tobacco Products Act, 2003 in Crime No.62 of 2026 on the file of the respondent police seeks anticipatory bail.

The case of the prosecution is that the petitioner was found in illegal

possession of five packets of “Cool lip” and fifteen packets of “Hans” tobacco products, leading to the filing of the present complaint.

3. The learned counsel for the petitioner submitted that the petitioner is

innocent and a false case has been foisted against the petitioner and that he has

¶25

not committed any offence as alleged by the prosecution.

¶26

4. Per contra, the learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and submitted that the petitioner has four previous cases, which are similar in nature. Hence, he opposed to grant anticipatory bail to the petitioner.

5. I have given my anxious consideration to either side submissions.

Considering the nature of allegations, the fact that the petitioner has

four previous cases which are similar in nature, this Court is of the firm view that the petitioner, by misusing the liberty, keeps on continuing the offence without mending himself. Hence, the petitioner does not deserve anticipatory bail.
