This appeal has been filed by the State, being aggrieved by the observation made by the learned Single Judge in the order dated 24.05.2024, in W.P.No.13978 of 2024, that the Covid duty performed by respondent shall be treated as bond service and the consequential direction to appellants to return the original certificates to respondent without any delay.

Learned counsel for respondent submits that respondent, who has not served the bond period, is ready to serve, provided posting orders are issued by appellants within time frame.

Tamil Nadu [W.A.No.2583 of 2024 dated 20.11.2024] , wherein,

the Division Bench held that Covid service cannot be construed as bond service and therefore, the respondent is required to serve the remaining period of the bond service.

In the light of the above, the writ appeal is allowed, setting

¶34

aside the order of the learned Single Judge, on the following terms:

(a) The respondent shall report to the Director of Public Health for issuance of posting order and thereafter, the

respondent shall complete the bond service;

¶37

(b) Appellants are directed to issue posting orders to the respondent for serving the remaining period, within a period of two weeks from the date of reporting.
