Considering the fact that the application had been filed within the permitted statutoty period, this Court is of the view that if the application stands rejected, it could only be causing serious prejudice to the applicant/ defendant. Further, the reasons stated in the accompanying affidavit filed in support of this application and beings satisfied with the same, the application stands ordered and the delay is condoned.
