The petitioner apprehends arrest for the alleged offence under Sections 275 and 123 of BNS, 2023, Sections 6(b) and 24(1) of the Cigarettes and other

Tobacco Products Act, 2003, in Crime No.62 of 2026 on the file of the respondent police seeks anticipatory bail.

The allegation against the petitioner is that, he along with other

accused was found in illegal possession of banned tobacco products. Hence, the complaint.

The learned counsel appearing for the petitioner submitted that the

¶22

petitioner is innocent and has been falsely implicated in this case. He further submitted that he is ready to abide by any conditions that may be imposed by this Court. Hence, he seeks anticipatory bail to the petitioner.

The learned Government Advocate (Crl.side) appearing for the

respondent police reiterated the prosecution case and submitted that the petitioner has four previous cases, pending against him. Hence, he opposed to grant anticipatory bail to the petitioner.

I have given anxious consideration to the submissions made by the

learned counsel on either side and also perused the records available.

¶27

Considering the nature of the allegations, the fact that the petitioner

¶28

has four previous cases pending against him, this Court is not inclined to enlarge the petitioner on anticipatory bail. Accordingly, this Criminal Original Petition is dismissed.
