(Comm. Div.) No. 251 of 2022.

By judgment dated 19.01.2024, the suit was decreed by directing the

defendants to pay the plaintiffs a sum of Rs.10,83,99,250/- with interest at 12%

per annum on Rs.8,56,00,000/- from 06.06.2022 till the date of realisation. The plaintiffs have applied for return of the original networth certificates of Mr.Pramod Naik, husband of the first respondent and Mr.Suryakant Dhondu Walavalkar, the second respondent/second defendant. These documents were filed in original along with the plaint by the plaintiffs.

The first and second defendants were set ex parte in the suit. Learned

counsel for the third defendant submits that she has no objection to these documents being returned to the plaintiffs.

Learned counsel for the plaintiffs submits that these documents are

required in relation to the initiation of execution proceedings.

Considering the aforesaid, this application is allowed as prayed for. The Registry is directed to return these documents to the plaintiffs within two weeks from the date of receipt of a copy of this order.
