Common order, Madurai Bench of Madras High Court (B. Pugalendhi, J.), 26.09.2025 - W.P.(MD)Nos.6499 to 6504 of 2023: six writ petitions by the Management of The Thanjavur Central Co-operative Bank Ltd. under Article 226 seeking certiorari quashing of orders dated 01.09.2022 of the Controlling Authority under the Payment of Gratuity Act 1972 in P.G.Nos.33, 26, 27, 29, 30 and 25 of 2013, which, on the retired employees' review applications, directed release of gratuity amounts already deposited towards their pre-absorption service in Primary Agricultural Co-operative Societies. Background: the employees were engaged ad hoc in PACS (1967/1969/1970/1972) and absorbed into the Central Co-operative Bank per G.O.Ms.No.331 (Co-operation, Food and Consumer Protection Department), dated 05.12.1988, on condition of fresh appointment; Clause 5 counts seniority only from joining the Bank and excludes PACS service, and Clause 9 of the Bank's Special Bylaw confines service benefits (pay, allowances, gratuity, provident fund) to post-joining service; gratuity for Bank-period service stood settled under the LIC-linked Group Gratuity Scheme. The Appellate Authority (detailed order dated 29.11.2017 in P.G.A.Nos.81 to 83, 85 to 87 of 2016) held the Controlling Authority incompetent where claims rest on a Section 12(3) Industrial Disputes Act settlement; this Court confirmed that view on 12.12.2018 dismissing the employees' writs (W.P.(MD)Nos.5794, 6021, 6042, 6107, 6166 and 6291 of 2018) with liberty to move the competent forum. The Controlling Authority nevertheless entertained the review and released the deposits, misconstruing that order, and had also disregarded the G.O./bylaw conditions (Section 2A and Section 7(3A) PGA having been invoked before it).
