Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus, to call for the records relating to the Order passed by the 3rd respondent, vide his Proceedings Na.Ka.No.1953/A2/2022, dated 12.06.2023 and quash the same as illegal and consequently to direct the Respondents 1 to 3 to approve the petitioners appointment as Physical Education Teacher, in the 4th respondent Concordia Higher Secondary School, Valliyur with effect from 16.04.2018, in conformity with the Order passed by the Honourable Administrator, the 5th respondent herein and release the arrears of salary and other benefits thereof within the period they may be stipulated under the circumstances of the case and pass such further or other orders as this Honble Court may deem fit and proper in the circumstances of the case and thus render justice.

This writ petition is filed challenging the order passed by the 3rd respondent, vide his Proceedings Na.Ka.No.1953/A2/2022, dated 12.06.2023 and seeking a consequential direction to the Respondents 1 to 3 to approve the petitioner's appointment as Physical Education

Teacher, in the 4th respondent Concordia Higher Secondary School, Valliyur with effect from 16.04.2018, in conformity with the Order passed by the Honourable Administrator, the 5th respondent herein and release the arrears of salary and other benefits thereof.

The issue in this writ petition was the subject matter of the writ petition in W.P.(MD).Nos.17689 of 2020 & 18245 of 2021, in which the order impugned herein had already been quashed by this Court by order dated 26.09.2023. It is also represented that the said order had been implemented by the respondents.

In view of the same, the order impugned herein in respect of the petitioner stands set aside and the respondents are directed to approve the appointment of the petitioner as Physical Education Teacher with effect from the date of his original appointment and disburse all necessary monetary benefits within a period of tweleve weeks from the date of receipt of a copy of this order.
