PRAYER : Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus directing the respondents to survey and earmark the petitioner's land by erecting the boundary stone, bearing Resurvey Number 252/7 to an extent of 9701 square feet situated at Ayan Samuthirapatti Village, Natham Sub Registration District, Dindigul Registration District on the basis of petitioners' online petition with registration number 2024/0123/13/007293 dated 28.10.2024 in the office of the respondents.

The petitioner seeks limited relief of issuance of Writ of Manadamus to survey and earmark the petitioner's land by errecting boundary stone. In this regard, the petitioner made an online application on 28.10.2024 before the respondents. The petitioner seeks expeditious survey to be conducted based on his application dated 28.10.2024.

2. Considering the limited relief sought for in this Writ Petition, with the consent of the learned counsel on either side, this Writ Petition itself is taken up for final disposal.

3 . The petitioner's application for survey is based on gift settlement

deed executed in his favour on 12.02.2024 in registered document No. 443/2024. There can be no impediment for the survey to be conducted

based on the petitioner's application, since prima facie no third party interest also appears to be involved.

4. In view of the above, the respondents are directed to conduct

survey based on the petitioner's online application dated 28.10.2024, within a period of eight weeks from the date of receipt of a copy of this order.

5. With the above direction, this Writ Petition is disposed of.

There shall be no order as to costs.
