PRAYER: Petition filed under Article 226 of the Constitution of India, to issue a writ of certiorari calling for the records pertaining to the impugned notice issued by the first respondent in Na.Ka.No.3981/2024/F3, dated 10.11.2025 and quash the same as illegal in respect of the petitioner is concerned.

The show cause notice-cum-notice, dated 10.11.2025, to remove the unauthorized structures, issued by the Dindigul Corporation to the petitioner, is under challenge in this writ petition.

The notice issued by the Commissioner, Dindigul Corporation, which is under challenge in this writ petition, indicates that this Court on 21.05.2025 in W.P.(MD) No.14526 of 2025, had directed the respondents to remove the unauthorized structures in the R.M.Colony promoted by the Tamil Nadu Housing Board. Pursuant to the said direction, the Commissioner, Dindigul Corporation, has issued the impugned notice dated 10.11.2025 directing the petitioner to submit her explanation within seven days as to why the unauthorized structures put up by her in the subject property should not be removed, failing which the unauthorized structures will be removed by the Corporation.

3. From the impugned notice, we also find that the show cause notice issued on 25.04.2025 issued in Na.No.3981/2024/F3, issued by Dindigul Corporation, did not evoke any response from the petitioner, which

has led to issuance of the impugned notice, dated 10.11.2025, under Section 128(1(a&b)) of the Tamil Nadu Urban Local Bodies Act, 1998.

4. We find no merit in this writ petition to interfere with the impugned notice. If the petitioner, so far, has not submitted her explanation to the impugned notice, she has to give her explanation forthwith. Considering the petitioner's explanation, the respondents are at liberty to proceed further and remove the unauthorized structures in the subject property in compliance with the orders passed by this Court in W.P.(MD) No. 14526 of 2025.

5. Accordingly, this writ petition is dismissed. No costs.

Consequently, connected miscellaneous petition is closed.
