PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of MANDAMUS directing the respondents 1 to 3 more fully 3rd respondent herein to consider the petitioner's representations dated 17.07.2017 and 17.08.2018 in accordance with law by considering to issue individual patta in favour of the petitioner in the light of assignment patta dated 12.03.2007 vide order No. 21087/2006/C3 issued by 3rd respondent in respect of the property comprised in S.No. 189/3 situated at Kinnimangalam, Thirumangalam Taluk, Madurai District within the time stipulated by this Court.

ORDER

An Assignment order in favour of the petitioner was issued on 12.03.2007. Such assignment order was subsequently cancelled by order dated 22.02.2008. The cancellation order was challenged in O.S.261 of 2008 before the learned District Munsif, Thirumangalam. By judgment and decree dated 05.02.2016, the suit was decreed in favour of the petitioner. The appeal filed against the judgment and decree was dismissed on 12.06.2020. No second appeal was filed and, therefore, the judgment and decree become final. In such circumstances, the petitioner had filed application for an individual patta. The present writ petition relates thereto.

Learned Government Advocate accepts notice for all the respondents.

He submits that the petitioner's request for patta would be considered and that order would be issued within three months.

directing the third respondent to consider and pass orders on the petitioner's request for individual patta within three months from the date of receipt of a copy of this order. No costs.
