This writ petition has been filed challenging the refusal check slip issued by the respondent dated 21.08.2024, thereby refused to register the release deed executed by the petitioners 1 to 5 in favour of the sixth petitioner in respect of the property comprised in Survey Nos.106/3 (0-86), 107/8B (0-43), 130/10B (0-64), 131/5B (0-12), 133/6 (0-28), 133/8 (0-34 ½), 135/2 (0-81 ½) , 135/3 (0-15) situated in Panaikudi Village, Tiruchuli Taluk, Virudhunagar District.
2. Heard the learned counsel appearing on either side and perused the materials placed before this Court.

executed two sale deeds vide document Nos.512/1997 and 513/1997 dated 02.06.1997 in favour of one Bimal Kumar Jalan in respect of land in Survey No.93/1. The recital of the sale deeds revealed that the said property was executed in favour of Bimal Kumar Jalan and if there is any encumbrance, it will be cleared through 'B' Schedule property, which is the subject property in the release deed. The said sale deed was executed in the year 1997 and the mother-in-law of the sixth petitioner died on 21.04.2021. The petitioners are being the legal heirs, they derived title over the subject property and they are in possession and enjoyment of the same. Some of the legal heirs relinquished their share in the subject property and executed a release deed in favour of the sixth petitioner, including the petitioners 1 to 5 herein on 21.08.2024 and the same was presented for registration before the respondent. The respondent refused to register the release deed on the ground that the recitals of the earlier sale deeds, which was executed by the mother-in-law of the sixth petitioner indemnify the subject property in favour of one Bimal Kumar Jalan and thereafter to clear the encumbrance.

the sixth petitioner. In view of the same, the impugned refusal check slip cannot be sustained and the same is liable to be quashed, accordingly, quashed. The petitioners are directed to represent the release deed for registration and after receipt of the same, the respondent is directed to register the same and handover the same forthwith, it is otherwise in order.
No costs. Consequently, connected Miscellaneous Petition is closed.
