Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus, to call for the records of the impugned Refusal Number: 19/2025 dated 23.07.2025 passed by the second respondent and quash the same as illegal and consequently direct the second respondent to permit the petitioner to purchase the properties in Survey Nos. 7/1A, 1/7, 4/7, 5/3, 7/2F, 2/9 and 3/1 situated at Pramanakulam Village, Kadaladi Taluk, Ramanathapuram District within the time stipulated by this Court.

2.Sale deed dated 06.01.2025 was executed in favour of the

petitioner / company. The document was presented for registration only on 04.07.2025. The case of the petitioner is that when the document was presented for registration immediately after execution, the registering authority did not entertain the same on the ground that objection was received from the third party. It appears that the civil proceedings

subsequently ended in favour of the vendors of the writ petitioner on 03.07.2025. On the very next day, the sale deed was presented for registration.

3.There is nothing on record to show that the document dated 06.01.2023 was presented immediately after its execution. Be that as it may, Section 23 of the Registration Act, 1908 states that no document other than a Will shall be accepted for registration unless it is presented for that purpose before the proper officer within four months from the date of its execution. In this case, the execution was on 06.01.2025, while the presentation took place after the lapse of four months. Therefore, in view of Section 23 of the Registration Act, 1908, I cannot fault the impugned decision.

4.I make it clear that all the other remedies open to the writ petitioner are left open. The petitioner can apply for refund of the stamp duty as well as registration charges since the registration formalities have not taken place. It is also open to the petitioner to sue his vendor for appropriate relief.

5.With the aforesaid liberty, this Writ Petition stands dismissed.

No costs. Consequently, connected miscellaneous petitions are closed.
