PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus to direct the respondents to Survey the petitioner's land in Survey No.242/3A (Old Survey No.242/3) to the extent of 11.5 cents situated at Veloor Village, Viralimalai Taluk, Pudukkottai District by considering the petitioner's vendor's application No.2025/0123/22/010454 dated 04.07.2025 within a time of period as framed by this Court.

By relying on a sale deed dated 14.07.2025 and patta No.6984 in the name of the petitioner, the petitioner had applied for a survey of the land in survey No.242/3A of an extent of 11.5 cents. On the ground that such application was not acted upon, the present Writ Petition has been filed.

Learned Additional Government Pleader accepts notice on behalf of both the respondents. On instructions, he submits that the petitioner's vendor's sister had raised objections to the conduct of a survey.

In response, learned counsel for the petitioner points out that a civil suit filed by the petitioner's vendor's sister (O.S.No.235 of 2015) was dismissed as settled out of court on 07.03.2017. Therefore, he submits that the said objection does not have any merit.

petitioner has made out a case to consider the request for survey. In view of the submissions of learned Additional Government Pleader, before conducting such survey, notice should be issued to the petitioner's vendor's sister, Periyakka and to the owners of relevant adjacent lands.

Subject to these observations, this Writ Petition is disposed of by directing the respondents to consider the petition's application and take necessary action within a period of twelve (12) weeks from the date of receipt of a copy of this order. No costs.
