The present writ petition has been filed seeking a direction to the respondents 1, 2 & 4 to 6 to take action against the respondents 7 to 18 for excommunicating the petitioner and his family and directing the respondents 1 to 6 to release the water from Pillur Periya Kanmai for irrigating the petitioner's agricultural field.

The learned counsel for the petitioner submitted that the fourth respondent/Tahsildar, Sivagangai District, has stopped the release of water from Pillur Periya Kanmai for irrigation to the petitioner's agricultural land.

In view of the said submission, this Court directed the Mr.M.Muthumanickkam, learned Government Advocate (Crl.Side) to direct the appearance of the fourth respondent before this Court forthwith and the matter was passed over. When the matter was taken up for hearing after lunch, Mr.Mallikarjunan, Tahsildar, Sivagangai District, is present before this Court along with Miss.Priya Darshini, the Assistance Engineer of Water Resource Department, Sivagangai District.

Miss.Priya Darshini, the Assistant Engineer of the Water Resource Department, Sivagangai District, submitted that because of the low-lying level of the water, when the petitioner sought for release of water from the Pillur Periya Kanmai, the PWD authorities were unable to release the water since there prevailed a situation which would give rise to law and order problem since a number of agriculturists depended upon the 'Ayakattu Irrigation Water'. The petitioner herein was not only relying upon the 'Ayakattu Irrigation Water', but also the well irrigation. However, now, due to heavy rains, sufficient water is available in Ayakattu and in view of the same, very soon the water will be released for the purpose of all the agriculturalists.

Recording the same, appreciating Miss.Priya Darshini, the Assistant Engineer of the Water Resource Department, Sivagangai District, who had appeared and reported before this court, this Writ Petition is disposed of by directing the respondents 3 & 4 to take necessary steps forthwith to release water for the agriculturists from the Pillur Periya Kanmai. No costs.
