This writ petition has been filed for a writ of Mandamus to direct the fourth respondent to grant permission to the petitioner to install a borewell and obtain electricity service connection in the leasehold premises in S.No.690/18, Padalayarkulam Village, Nanguneri Taluk, Tirunelveli District by considering his representation dated 23.07.2025.

This is the fourth round of litigation before this Court.

In WP(MD)No.14703 of 2025, the petitioner challenged the

proceedings of the second respondent herein/Joint Commissioner dated 12.05.2025, wherein, taking note of the certain decisions of this Court, this Court disposed of the writ petition with a direction to the petitioner to pay the admitted arrears of rent etc., The operative portion of the order reads as under:

11. Having considered the submissions of the learned counsel for the petitioner, the learned counsel for the fourth

respondent Temple and the learned Special Government Pleader for the H.R. & C.E. Department, this Court is inclined to pass the following order:-

(i) The petitioner shall pay the admitted arrears of Rs. 14,400/- per month, as undertaken in the representation dated 07.12.2022, for the period prior to 29.11.2022. The amount shall be calculated and paid to the fourth respondent Temple within four weeks from today.

(ii) Since the exercise mandated by the order dated 14.02.2022 [in terms of the decision of the Division Bench of this Court in Angala Parameswari's cae [cited supra]] has not yet concluded, fair rent shall be determined under Section 34-A of the H.R. & C.E. Act, in line with the said Division Bench judgment. This process shall be completed as expeditiously as possible, preferably within a period six weeks from the date of receipt of a copy of this order. It is made clear that the petitioner shall pay the fair rent once it is approved by the Committee constituted in terms of the decision of the Division Bench of this Court in Angala Parameswari's case [cited supra]. In the event of default, the respondents are at liberty to proceed in accordance with the impugned order.

Now, the petitioner has submitted a representation dated 23.07.2025,

requesting the fourth respondent to permit the petitioner to obtain an electricity connection and to sink a bore well in the leasehold land belonging to the fourth respondent.

The learned Standing Counsel for the fourth respondent submits that

the fourth respondent has no objection to such request, provided such application are made to the concerned statutory authority in the name of the Temple and the expenses are borne by the petitioner.

Recording the same, the writ petition is disposed of by permitting the

petitioner to obtain electricity connection and sink a bore well by obtaining necessary permission in the name of the fourth respondent temple. Before filing such applications, the petitioner shall get the application counter signed by the Executive Officer of the fourth respondent Temple. No costs.
