[Order of the Court was made by S.M.SUBRAMANIAM, J.]

The notices issued by the Revenue Tahsildar, Sivagiri, Taluk, Tenkasi District, dated 06.08.2024, are under challenge in W.P.(MD) Nos. 20398, 21686, 22194 of 2024 & 1579, 3258, 3259, 3260 & 3261 of 2025 and W.P.(MD) Nos.20173 & 20397 of 2024 have been instituted seeking for issuance of a writ of mandamus to forbear the respondents in the said writ petitions from in any way interfering with the running of small-scale brick kilns units by the petitioners in the said writ petitions without considering their applications for issuance of license pending before the second respondent therein.

2. The impugned notices have been issued pursuant to the directions issued by the National Green Tribunal, Southern Region, Chennai, vide order dated 24.07.2024, passed in O.A.No.221 of 2024. If any grievance

exists, the petitioners concerned have to approach the National Green Tribunal or in the alternate, they have to submit their explanation to the impugned notices. Contrary, such disputed issues cannot be decided in a writ jurisdiction under Article 226 of the Constitution of India. Brick kilns causing environmental damages is the issue considered by the National Green Tribunal in the said O.A.No.221 of 2024. That being so, the petitioners concerned are at liberty to submit their explanation to the impugned notices or in the alternate, to approach the National Green Tribunal for redressal of their grievance, as the case may be.

3. At this juncture, learned counsel for the petitioners in W.P.(MD)

No.20173 of 2025 would submit that the petitioners have submitted applications to the authority concerned seeking renewal of licence.

¶171

4. Even in such circumstances, the Pollution Control Board has to conduct inspection and issue necessary no objection certificate for the purpose of considering the case of the applicants. In all these cases, High Court cannot decide the issue involved in the case on hand and it requires elaborate inspection, field inspection etc., and no objection certificate is to be

obtained from the Pollution Control Board and other competent authorities. More so, in the present case, the National Green Tribunal has passed an order, which has resulted in issuance of the impugned notices. That being so, such issue cannot be considered on merits in the writ jurisdiction.

5. With the above observation, these writ petitions are disposed of.

No costs. Consequently, connected miscellaneous petitions are closed.
