PRAYER: Writ Petition filed under Article 226 of the Constitution of India, to issue a Writ of Certiorarified Mandamus, to call for the records relating to the impugned proceedings bearing No.Pension -4/13228/2013 dated 17.03.2022 issued by the first respondent withholding Rs.3,03,249/- from my DCRG amount towards the alleged final loss and impugned proceedings No.PT1/17696/2012 dated 17.08.2022 issued by the second respondent declining to pay interest on delayed payment of pension arrear and quash both the proceedings and consequently direct the respondents to release / disburse Rs.3,03,249/- and to pay interest at 12% per annum on pension arrears from the date it fell due within a time frame.

presented his case. A stand has been taken by the respondents through their counter that there is no provision under the Tamil Nadu Pension Rules, 1978, for payment of interest other than for delayed payment of gratuity. In the present case, the petitioner seeks for payment of interest for delayed payment of terminal benefits by the respondent Board. On 24.09.2025, learned Counsel for the petitioner sought time to produce authorities on the next hearing date in support of his contention that for delayed payment of pension, the petitioner is entitled for payment of interest. On a request made by the learned Counsel for the petitioner, to enable the learned Counsel for the petitioner to produce authorities, this Court adjourned the matter to 10.10.2025. However, on 10.10.2025 , learned Counsel for the petitioner once again sought an adjournment. At the request of the learned Counsel for the petitioner on 10.10.2025, this Writ Petition has been adjourned today.

3. Today, there is no representation for the petitioner. As seen from the earlier proceedings when the matter was listed before this Court on 12.09.2025, there was no representation on the side of the petitioner and since there was no representation on 12.09.2025, this Court had posted the matter for hearing on 24.09.2025 under the caption “for dismissal”.

Since learned Counsel for the petitioner has not produced authorities in support of the petitioner's contention that the petitioner is entitled for interest for the delayed payment of terminal benefits by the respondent Board and since this Writ Petition was already posted under the caption “for dismissal” earlier and only on the request made by the learned Counsel for the petitioner the dismissal caption was removed and since there is no representation for the petitioner once again today, it can now be inferred that the petitioner is not interested in prosecuting the Writ Petition.

5. Accordingly, this Writ Petition stands dismissed for nonprosecution. There shall be no order as to costs. Consequently, the connected miscellaneous petition is closed.
