PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus , directing the 1^st respondent herein to consider the petitioner's withdrawal petition dated 14.10.2024, and further permitting the petitioner to withdrawal the award amount sum of Rs.13,53,753/- with interest within stipulated time limit fixed by this Court .

The present writ petition has been filed by a beneficiary of the order dated 14.10.2024, passed by the first respondent herein in W.C.No.8 of 2017.

2.A perusal of the order of the first respondent reveals that the second respondent/Contractor has been directed to deposit the award amount. According to the petitioner, award amount has already been deposited by the second respondent. The petitioner herein has filed an application to withdraw the amount on 14.10.2024 and again on 19.03.2025. Based on the said request, the first respondent has already sent notice to the second respondent on 01.04.2025. Despite the above said facts, no orders have been passed in the withdrawal application. Hence, the present writ petition.

3.Considering the above said facts, the first respondent is directed to pass orders on withdrawal application within a period of 4(four) weeks from the date of receipt of a copy of this order.

4.Accordingly, this Writ Petition stands disposed of. No costs.
