This writ petition has been filed seeking a direction to the respondent to consider his representation dated 29.04.2025 seeking issuance of patta in respect of the land in Survey No.127, Andipatti Village, Palani Taluk, Dindigul District.

2.Heard the arguments of Mr.S.Sukumar, learned counsel appearing for the petitioner and Mr.M.Gangatharan, learned Government Advocate appearing for the respondents. By consent of both sides, this Writ Petition is taken up for final disposal at the admission stage itself.

3.It is the case of the petitioner that 5 acres of land in the above mentioned survey number was assigned by the Boomithan Board in favour of one Karupanagounder in the year 1989. However, the said assignee abandoned the land and the petitioner has been in continuos possession and enjoyment for the past 33 years. On the strength of long possession, the petitioner submitted a representation before the respondents seeking issuance of patta in his name. The same has not been considered. Therefore, the petitioner has come before this Court.

4.It is seen from the averments contained in the affidavit, the subject property was originally assigned in favour of one Karupanagounder and he abandoned the same. However, the petitioner claims he has been in possession and enjoyment of the property for the past 33 years. The petitioner is not a legal representative entitled to succeed to the estate of Karupanagounder. Therefore, the revenue authorities may not be in a position to consider the request of the petitioner for issuance of patta. In these circumstances, it is for the petitioner to approach the competent authority, namely the Boomithan Board/Commissioner of Land Administration for assignment of land in his favour.

5.Accordingly, this Writ Petition is dismissed with liberty to the petitioner to approach the competent authority, namely, the Commissioner of Land Administration for assignment of land in his name on the strength of long possession. No costs.
