further vacate the delinquent members of the 2 nd respondent, their henchmen, supporters by ensuring that no delinquent members assemble illegally in any form within the radius of 700 meters from the petitioner company premises, viz., A1B & A1C, MMDA Industrial Complex, Maraimalai Nagar, Chengalpattu Taluk, Kanchipuram District, pursuant to the petitioner's complaint dated 03.06.2025 .

The Writ Petition (Criminal) has been filed seeking a direction to the 1st respondent to provide adequate police protection to ensure free ingress and egress of vehicles and persons in and out of the petitioner Company premises and to remove the delinquent members of the second respondent or their supporters, by ensuring that no such delinquent members assemble illegally in any form within a radius of 700 meters from the petitioner Company premises, pursuant to the petitioner's complaint dated 03.06.2025.

Heard both sides and perused the materials available on record.

It appears that there exists a dispute between the petitioner Company and the second respondent Union. Against the conciliation proceedings, the second respondent is conducting strike and indulged in illegal acts of intimidation and obstruction, including threatening the employees of the petitioner Company and preventing the ingress and egress of vehicles and movement of goods. Thereby, the petitioner lodged a complaint dated 03.06.2025 before the first respondent. However, since no action has been taken by the first respondent, the present writ petition has been filed.

In view of the above, this Court is of the considered opinion that though the employees have the right to protest, they are not entitled to prevent the ingress and egress of vehicles to and from the factory premises, nor they can obstruct the removal of goods from the company. Any protest must be conducted in a peaceful and democratic manner and only after obtaining prior permission from the jurisdictional Police, in the place earmarked for such purpose by the authorities concerned.

5. If at all the second respondent Union intends to continue its protest, it may conduct the protest at a distance of not less than 200 metres

from the Company premises and only after obtaining prior permission from the jurisdictional Police. In the event of any law and order issue arising from

such protest, it shall be the duty of the Police to provide necessary protection to ensure that no such incident occurs within the factory premises.

Accordingly, this Writ Petition (Criminal) stands disposed of with the above directions. No costs. Consequently, the connected miscellaneous petition is closed.
