The petitioner/ Insurance Company has filed the present writ petition to

direct respondents 1 and 4 to 6, to constitute a Special Investigation Team to

investigate the cases of False Insurance Claims and consequently direct the Special Investigation Team to file final report with the Principal District Judge,

Krishnagiri for further adjudication and to consequently direct the 2 nd respondent to issue direction to all Government Hospital Authorities to furnish the copy of Accident Register, Copy of Wound Certificate, Discharge Summary as per request made by petitioner.

In response, Mrs.S.Anitha, learned Special Government Pleader appearing for respondents 1, 2 and 4 to 7 has filed a counter affidavit in support of this writ petition and would submit that with regard to the first part of the prayer, i.e., petitioner's request for investigation of false Insurance Claims, a Special Investigation Team (S.I.T) was formed by the Additional Director General of Police in C.No.C1/EOW/368/201 dated 20.04.2021, in compliance with the directions of this Court in Crl.OP.No.2302 of 2021 dated 09.02.2021 and 22.03.2021 and that the present complaint of the petitioner has been transferred to the Special Investigation Team. She would further submit that with regard to the second part of the prayer, i.e., to direct the 2 nd respondent to issue Circular to all Government Hospital and Medical College to permit their agents to peruse the Accident Register and to direct the Motor Accident Tribunal to reopen the fraudulent Motor Accident claim, the same is not within the purview of the respondents herein.

3. In view of the above, if at all the petitioner has any grievance for nonregistration of criminal case in respect of false Insurance Claims, the petitioner is granted liberty to approach the Special Investigation Team for registration of the case, in accordance with law.

4. Recording the same, the writ petition stands disposed of. No costs. Consequently, the connected miscellaneous petition is closed.
