This writ petition has been filed seeking issuance of a writ of

mandamus directing the respondents to pass orders on the representation

made by the petitioner on 09.12.2024.

When the matter came up for hearing on 25.02.2025, the

following order was passed by this Court:

"Mr.A.Selvendran, learned Special Government Pleader, takes notice for respondents.

It is seen from records that pursuant to the orders passed by the Division Bench of this Court in W.A.No.2873 of 2023 dated 11.07.2024, the survey has been conducted and boundaries have been demarcated and the same is apparent from the report of the Tahsildar dated 15.10.2024. The petitioner now wants to put up fencing around the boundaries that have already been demarcated. There seems to be some objections regarding the same. Hence, learned Special Government Pleader appearing on behalf of the respondents shall take instructions and report before this Court.

This court directed the learned counsel for the petitioner to take instructions from the petitioner as to whether the fencing can be done without disturbing the present understanding of permitting the pathway to be utilized and to fence the remaining portion of the property. The learned counsel for the petitioner seeks for some time.

When the matter was taken up for hearing today, learned counsel for the petitioner, based on the instructions received from the petitioner, submitted that fencing will be done without disturbing the pathway, which is being utilized by others.

Considering the facts and circumstances of the case and

taking note of the submission made by the learned counsel for the petitioner based on the instructions received by him, the petitioner shall

be permitted to put up fencing around her property based on the boundaries that have already been determined in the survey that was conducted without disturbing the pathway that is being utilized presently. The second respondent shall ensure that this process is completed in a smooth manner.

This writ petition is disposed of in the above terms. No costs. Consequently, connected miscellaneous petition is closed.
