The prayer of the writ petitioner is to conduct election to the Trust Board and also to allow the petitioner to cast his vote as per the scheme framed in O.A.No.144 of 1968 dated 05.03.1973, based on the representation of the petitioner dated 01.12.2025.

The grievance of the petitioner is that even though there is an earlier order passed by this Court in W.P. No.43883 of 2025 to conduct the election, till date the election has not been notified. As per the scheme, the petitioner is also entitled to vote in the election. Therefore, the petitioner has come up with this writ petition for both the prayers.

When the matter was taken up for hearing, the learned Additional Government Pleader appearing for the respondents would submit that pursuant to the order, the respondents are in the process of notifying the election and very soon the election will be notified. While issuing the notification, the electoral roll will also be notified. Therefore, the petitioner has prematurely come before this Court.

The time which is granted by this Court in the earlier order was to

conduct the election within a period of eight weeks from the date of receipt of the order. It is represented that the eight weeks time expires in February 2026 and therefore the respondents still have time. While publishing the electoral roll, the representation of the petitioner shall also be considered in accordance with law. It is made clear that the right of the petitioner, one way or the other, is not determined by this Court and the same will also be considered while the respondents publish the electoral rolls.

Accordingly, this writ petition stands disposed of. Consequently,

connected miscellaneous petitions are closed. No costs.
