PRAYER: This writ petition is filed under Article 226 of the Constitution of India praying to issue a Writ of Certiorarified Mandamus calling for the

records on the file of the respondent herein vide Refusal order No. RFL / Tharamangalam /47 /2025 dated 18/11/2025 and quash the same consequently direct the Respondent to register the Award of Lok Adalat in O.S.No.90/2019 Sub-court at Omalur, Salem District.

A Will was executed by the petitioner’s aunt, Lakshmi, in favour of
the petitioner. The petitioner filed O.S.No.90 of 2019 seeking a declaration
that the said Will is valid and binding. Pursuant to a reference to the Lok Adalat, the matter was settled between the parties and an award was issued.
The petitioner presented the award for registration. Such request was rejected by the impugned order.

2. Learned Special Government Pleader accepts notice for the sole
respondent. He submits that if a certified copy of the award and judgment
were to be presented, necessary action would be taken.
3. On perusal of the impugned refusal check slip, it is clear that the
petitioner was called upon to submit the Lok Adalat award and the judgment in relation thereto. Therefore, this writ petition is disposed of by permitting the petitioner to submit the certified copy of the award and the judgment of
the Court disposing of the suit as settled in terms of the award. Within two weeks from the receipt of the above, the Sub Registrar is directed to take necessary steps to register the instrument subject to fulfillment of other
requirements in this regard. No costs.
