Prayer: Petition filed under Article 226 of the Constitution of India seeking issuance of a writ of certiorarified mandamus to call for the records relating to impugned order passed by 2^nd respondent dated 1.2.2023 in Na.Ka.No.11353/2022/ADW/Ko.1 and to quash the same in respect of schedule-2 of the order is concerned and consequently direct 2^nd respondent to allot free housing sites patta to the Adi Dravidar people of Manjanayakkanaalli Village Panchayat in respect of land in Survey No.40/2B measuring to an extent of 3.63.50 hectares situated at Kadamadai Colony, Manjanayakkanaalli Village, Pennagaram Taluk, Dharmapuri District.

When we were questioning the locus of petitioners to seek a

certiorarified mandamus by way of this public interest litigation, Shri Prabakar appearing for respondent Nos.1 to 6, relying on the report of the Special Tahsildar (ADW), respondent No.5, submitted that 43 plots have been identified, of which 41 may be allotted to the members of Kadamadai

Village. Paragraph (6) of the report reads as under:

“6. At present there is 43 vacant plots are available in above mentioned Survey no of Kadamadai village in which 41 above mentioned newly selected beneficiaries of Kadamadai village have to be assigned to grant e-pattas and and continuous action is being taken to grant e-pattas to the above mentioned 41 beneficiaries.”

Shri Prabakar stated that the members concerned of the said village can approach respondent No.5 for necessary action. Shri Prabakar states respondent No.5 shall consider the applications and dispose the same within six weeks of receiving the same.

Petition is disposed of accordingly. There shall be no order as to costs. WMP No.4485 of 2025 filed to permit petitioners to file a single writ petition is allowed, inasmuch as they have paid separate court-fee. Other interim applications are closed.
