This writ petition has been filed seeking issuance of a writ of mandamus directing the respondents 1 to 4 to deal with the representation made by the petitioner wherein the petitioner has sought for cancellation of the patta standing in the name of respondents 6 to 11 with respect to the subject property.

Heard Mr.Satheeshkumar Manimaran, learned counsel for

petitioner and Mr.A.Selvendran, learned Special Government Pleader appearing for respondents 1 to 5.

The petitioner is claiming right over the property through her

grand father and his wife. According to the petitioner, they were in possession and enjoyment of the property and they were cultivating the lands. Thereafter, the petitioner continued to cultivate the land and the adangal stands in the name of the petitioner. While so, the patta was issued by showing the nature of land as 'tharisu nilam' in the name of respondents 6 to 11. Aggrieved by the same, the petitioners made a representation before the official respondents seeking for cancellation of

patta granted in favour of respondents 6 to 11. Since the same was not considered, the present writ petition has been filed before this Court.

Taking into consideration the facts and circumstances of the

case and considering the nature of grievance of the petitioner, there shall be a direction to the petitioner to submit a fresh representation before the first respondent along with all the relevant documents. On receipt of the same, the first respondent shall issue notice to all the interested parties and shall consider the representation made by the petitioner on its own merits and in accordance with law and final orders shall be passed within a period of three (3) months from the date of receipt of fresh representation from the petitioner.
